RE: The tariff classification of housed bearings from China.

Dear Mr. Krueger:

In your letter dated January 29, 2001 you requested a tariff classification ruling on behalf of your client Canimex.

The items in question are described as types of housed bearings, which include:

- pillow blocks formed of either cast iron or pressed steel, incorporating ball bearings;

- flanged housings in a range of configurations, e.g., round, oval, square, formed of either cast iron or pressed steel, incorporating ball bearings;

- a disk harrow unit, which is a ball bearing housed in a square flanged unit of pressed steel with enhanced seals to seal against dust, dirt and water.

You indicate that the housings may in some cases be presented separately, without a bearing. Descriptive literature and illustrations were submitted.

The applicable subheading for the flanged housings and disk harrow unit, when each is presented incorporating a ball bearing, will be 8483.20.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for housed bearings, flanged units, incorporating ball bearings. The rate of duty will be 4.5 percent ad valorem.

The applicable subheading for the pillow blocks, when each is presented incorporating a ball bearing, will be 8483.20.8040, HTSUS, which provides for other housed bearings, incorporating ball bearings. The rate of duty will be 4.5 percent ad valorem.

The applicable subheading for the pillow blocks, when each is presented separately without a bearing, will be 8483.30.8020, HTSUS, which provides for other bearing housings, ball or roller bearing type. The rate of duty will be 4.5 percent ad valorem.

The applicable subheading for the flange units and disk harrow unit, when each is presented separately without a ball or roller bearing, will be 8483.30.4040, HTSUS, which provides for bearing housings, flange units, ball or roller bearing type. The rate of duty will be 4.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
